2009-07-17 car stop

Timeline:

Friday July 17th, 2009: While driving in the Nashua area with Yadra when an officer pulls them over supposedly due to Kurt’s dog sitting in his lap as he drove. Kurt refuses to provide the officer with identification or registration and is arrested. He went to put up his window catching the officers arm in the window. Apparently due to the officer attempting to open the door from the inside though this is yet to be confirmed. His car is towed. At the Nashua police station Kurt refuses to go along with booking and due to it being a Friday night is to be held till Monday July 20th, 2009 for arraignment.

Monday July 20th, 2009: At the arraignment the judge accuses Kurt of having an attitude and makes comments claiming she “hard pressed to believe that someone would refuse to allow her to do her job to protect their constitutional rights.”

He was charged with:

  • violation
    • unsafe driving for a dog riding in his lap
  • class A misdemeanors
    • disobeying  an officer
    • resisting arrest
    • assaulting an officer

As a result of Kurt’s “attitude”, which Mike Barskey claims he did not have, Kurt was given $1000 cash bail rather then personal recognizance. He refuses to post bail and therefore will be kept in jail till bail posted or his trial. He was given a court date of August 20th, 2009.

Monday July 27th, 2009: Kurt was bailed out.

October 1st, 2009: Kurt was found guilty:

Prosecutor recommended 90 days suspended for the assault charge, plus two $200 fines for the disobeying and resisting. Judge knew Kurt had been in jail for 14 days, so he instead gave him a $700 fine (plus 60 days suspended), which just so happens to mean “time served.”
